Weight Loss Navigator (the "app" or "platform") is owned and operated by Simplify It LLC ("we," "us," or "our"). By accessing or using the app or this website, you agree to be bound by these Terms of Service. If you do not agree, please do not use the app.

1. The Service

Weight Loss Navigator is a calorie and energy tracking tool that helps you estimate your daily calorie needs, log food and workouts, and monitor a calorie deficit over time. Features may include an estimated Total Daily Energy Expenditure (TDEE) calculation, food and workout logging, AI-assisted calorie estimates, deficit streaks, and progress tracking. We may add, change, or remove features at any time.

2. Not Medical Advice

Weight Loss Navigator is provided for general informational and educational purposes only and is not medical, nutritional, or professional advice. We are not doctors, dietitians, or licensed health professionals. TDEE figures, calorie estimates, and progress projections, including AI-generated estimates and the general guideline that roughly 3,500 calories of deficit equals about one pound, are approximations and may not reflect your actual needs. Consult a qualified healthcare provider before starting any diet, weight loss, exercise, or nutrition program, particularly if you are pregnant or nursing, under 18, have a medical condition, or have a history of disordered eating. Do not use the app to diagnose or treat any condition. You use the app at your own risk.

3. Eligibility

You must be at least 13 years old to use the app, and at least the age of majority in your location (typically 18) to purchase a subscription. If you are under 18, you may use the app only with the involvement and consent of a parent or legal guardian. By using the app, you represent that you meet these requirements and that the information you provide is accurate.

4. Accounts

Some features require an account. You agree to provide accurate information, keep your password secure, and remain responsible for all activity under your account. Notify us at scott@simplifyitlabs.com if you believe your account has been accessed without your permission.

5. Subscriptions and Billing

Weight Loss Navigator is a paid subscription service. Subscriptions are offered on a monthly or annual basis at the prices shown in the app and on the app stores. All purchases are processed by Apple's App Store or Google Play, not directly by us. Billing, renewals, and payment methods are governed by your app store account and its terms.

Subscriptions renew automatically until cancelled. You can manage or cancel a subscription at any time in your device's app store settings; cancellation takes effect at the end of the current billing period. Except where required by law or by the applicable app store's policies, payments are non-refundable, and refund requests are handled by Apple or Google under their own policies.

6. AI Calorie Estimates

The app can generate calorie estimates from a description of a meal. These estimates are automated approximations, may be inaccurate, and are meant to be reviewed and adjusted by you. Do not rely on them for medical, allergy, or precise nutritional decisions.

7. Your Content

You keep ownership of the information you enter, such as food and workout logs and weight updates. You grant us a limited license to store and process that information so we can operate and improve the app, as described in our Privacy Policy. You are responsible for the accuracy of what you enter.

8. Acceptable Use

You agree not to:

Use the app for any unlawful purpose or in violation of these Terms.
Reverse engineer, decompile, or attempt to extract the source code of the app.
Interfere with, disrupt, or place undue load on the app or its servers.
Access the app through automated means or scrape its data.
Resell, sublicense, or commercially exploit the app.
Infringe the rights of, or misuse the data of, other users or third parties.

We may suspend or terminate access for any violation.

9. Intellectual Property

The app, including its design, text, graphics, logos, and software, is owned by Simplify It LLC or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive, and revocable license to use the app for your own personal, non-commercial use. All rights not expressly granted are reserved.

10. Third-Party Services

The app relies on third-party services, including Apple, Google, and providers that support features such as AI estimates and subscription management. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services.

11. Disclaimer of Warranties

The app is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted or error free, or that any calculation, estimate, or result will be accurate or produce any particular outcome.

12. Limitation of Liability

To the fullest extent permitted by law, Simplify It LLC and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, health outcomes, or profits, arising from your use of or inability to use the app. Our total liability for any claim relating to the app will not exceed the amount you paid us for the app in the twelve months before the claim arose.

13. Indemnification

You agree to indemnify and hold harmless Simplify It LLC and its owners from any claims, losses, liabilities, or expenses arising out of your use of the app or your violation of these Terms.

14. Termination

You may stop using the app at any time. We may suspend or terminate your access at any time, with or without notice, including if we discontinue the app. Provisions that by their nature should survive termination, such as intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

15. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with a revised effective date. Your continued use of the app after changes take effect means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of the United States and the state in which Simplify It LLC is organized, without regard to its conflict of laws principles. You agree that any dispute relating to these Terms or the app will be resolved in the courts located in that state.
